About the Role
The Legal Counsel – Intellectual Property will report to the Director of Legal and will provide legal advice and support to Brisbane 2032 across intellectual property and rights protection matters. The commercial value of the Games is found in the value of its IP and its brand. Over the next six years, Brisbane 2032 will seek to raise significant commercial revenue by granting third parties the right to associate themselves with Brisbane 2032 on an exclusive basis. Attracting and retaining this commercial revenue is crucial to ensuring that the Games can be delivered in a cost neutral way.
Key Responsibilities
Rights Protection: The role will support the Director of Legal in the delivery of the rights protection program. This will include:
- Monitoring and enforcement in relation to:
- unauthorised use of Brisbane 2032 protected intellectual property;
- ambush marketing and unauthorised claims of association with Brisbane 2032 or any other protected stakeholder or asset;
- importation and/or sale of counterfeit merchandise; and
- unauthorised broadcasting;
- Liaising with rights protection partners such as the Australian Olympic Committee, Paralympics Australia, the International Olympic Committee and the International Paralympic Committee in relation to all rights protection matters.
Intellectual Property: The role will support the Director of Legal to provide high quality, fit for purpose advice and support in relation to intellectual property matters. Key intellectual property responsibilities will include:
- Registration and ongoing management of official Brisbane 2032 trade marks;
- Obtaining clearances in relation to key intellectual property assets;
- Drafting and negotiating contracts relating to the licencing and use of intellectual property assets;
- Licensing and assignment of intellectual property in accordance with Olympic Host Contract requirements; and
- Obtaining approvals and complying with intellectual property processes implemented by the International Olympic Committee and International Paralympic Committee.
Skills and Experience
- Minimum 5 years’ post admission experience, preferably within a top tier law firm.
- Strong knowledge of intellectual property laws and extensive experience in advising on intellectual property and rights protection matters.
- Knowledge of international intellectual property protection frameworks.
- Experience in the registration, management, enforcement and protection of trade marks and brand assets.
- Proven ability to deliver high-quality, timely legal advice and independently manage end-to-end matters, supported by strong commercial acumen, negotiation skills, and experience overseeing professional advisors.
- Demonstrated ability to manage difficult stakeholder groups with conflicting interests, adapting communication and support styles to accommodate the varying needs of clients from junior employees through to senior executives.
